Can I still apply for citizenship of a green card if I was convicted of assault?

I was in a fight with my ex in 2008 and was convicted of 5th degree assault misdemeanor. My green card expires in 2013 and I just wanted to know if I would still be able to apply for citizenship of a green card? Or would I be deported?

The answer to your question depends upon the specific charges upon which you were convicted. Some assault charges especially those dealing with domestic violence can result in USCIS attempting to revoke your permanent resident. While other charges may make you ineligible for citizenship, but still allow you to keep a green card. Please note that any conviction can be a factor in determining your eligibility for citizenship. It would be in your best interest to meet in person with an attorney, such as our office, to determine your eligibility. The attorney can discuss the case in more detail and review any documents you have related to the case.
