My fiance and I have been together for 11 years and we have 2 kids together. Can he apply for a green care after we get married? What the requirements?

You may be able to file for a green card. The first step is to be married to a U.S. citizen. Your spouse will file an immigrant visa petition on your behalf and you will simultaneously file an application for a green card. To be eligible for a green card, the immigrant visa must be approved (i.e. you must establish your marriage is bona fide). You must also demonstrate that you entered the country legally (some visas are still problematic) or are eligible for INA 245(i) benefits. You must also demonstrate that you have not been arrested and/or convicted of certain crimes. Finally, you must demonstrate that you merit a green card as a matter of discretion. It is important that you and your fiancé consult an experienced immigration attorney is there are a lot of nuances in immigration law. The attorney can review your documents and discuss the matter in detail to determine whether you are eligible.
